General Terms and Conditions (GTC)

All services provided by ARB Fitness GmbH are subject to these terms and conditions in their entirety, unless they have been amended or supplemented by written agreements.

Object of service

• ARB Fitness GmbH undertakes to offer the customer targeted and individualized training and health support.
• Unless otherwise agreed, the training and health support can only be used by the client in person.
• The agreed training and support service is to be understood as a contractual agreement within the meaning of the Swiss Code of Obligations.

General information

• In principle, a service lasts 55 minutes.
• We ask you to arrive on time in order to guarantee efficient and effective training to achieve your individual goals (and because it is at the expense of your time).

Liability

• ARB Fitness GmbH provides the agreed service with the necessary care and is liable for damages to the customer insofar as they have their direct cause in a proven intentional or grossly negligent breach of contractual obligations or other duties of care by ARB Fitness GmbH. To the extent permitted by law, any further liability arising from contract or other legal grounds is expressly excluded.
• ARB Fitness GmbH is not liable for any failure to achieve the purpose pursued by the customer in entering into the contract beyond the provision of the service owed.

Prices and terms of payment

• Subscriptions can be paid for in monthly installments or in full.
• Invoices for booked training units are issued in advance. The amount owed must be paid within 10 days of invoicing, in cash or by bank transfer.
• Monthly payments are generally made at the end of the month.
• The prices on the price list apply, they are exclusive of expenses (travel costs according to time spent with an hourly rate of 180.-).

Initial check

• The initial check is the basic assessment that every customer has to undergo. This enables the health status to be assessed and the scope of training and subscription to be agreed with the customer. This is obligatory for the security of ARB Fitness GmbH.
• The initial check takes 60 minutes and costs CHF 180. If you take out a subscription for at least 3 months, the amount will be credited to you.
• The customer must answer all questions truthfully.

Insurance/liability

• Insurance is the responsibility of the participant. ARB Fitness GmbH accepts no liability for accidents and illnesses.

Details of training or consultation appointments

• Services can only be used by the customer him/herself.
• Appointments are agreed verbally or in writing.
• Services must be redeemed within the specified time. There is no entitlement to a refund or reduction for unused services.

Prevention in personal training

• If the customer is unable to attend, he/she must inform the personal trainer as soon as possible, but at least 24 hours before the training or consultation appointment. In the event of non-notification or late notification, the training or consultation appointment will be charged in full. Exceptions are emergencies.
• If the personal trainer is unable to attend, the training or consultation appointment will be rescheduled. No claims for compensation can be made.
• If a training session is delayed, too dangerous or impossible due to unforeseeable circumstances (weather conditions, etc.), the training session will be postponed by mutual agreement. The decision will always be made by mutual agreement with the customer. The booked training time cannot be extended in the event of delays caused by the customer.

Small group personal training

• The minimum duration of the subscription is 3 months at the beginning, after which the customer is free to choose between 1, 2, 3, 6 or 12 month subscriptions.
• The subscription is usually billed monthly, but can also be paid for several months at once.
• Training times and price structure can be found on the homepage.
• No absences or missed appointments will be deducted from the subscription.
• If the customer is unable to attend, he/she must inform the trainer as soon as possible, but at least 24 hours before the training date. In the event of non-notification or late notification, the training date will be charged in full. This does not apply in the event of an accident or death in the family.
• Vacations are already included in the small group training.
• The running times of the small group training are fixed.
• In the event of illness or accident, the subscription can be interrupted and extended accordingly on presentation of a medical certificate.
• Only the small group personal training sessions led by Anina are recognized by health insurance companies.

Additional services

• If a service is used in a fitness club or other designated training facility, any costs incurred as a result, in particular admission costs for the customer and the personal trainer to the fitness center or for space rental, shall be borne by the customer.
• Costs are agreed verbally unless they are listed in the price list.

Miscellaneous

• If a subscription can no longer be used (illness or accident), the service can be purchased at a later date upon presentation of a corresponding medical certificate. Training sessions can also be transferred to another person by arrangement. No training sessions will be refunded.
• The trainer takes films and photos for social media, if this is not desired, you can inform the trainer. We are happy to take this into consideration.

Data protection and confidentiality

• All customer data collected will be treated as strictly confidential at all times, regardless of a possible termination of the contractual relationship, and will only be passed on to third parties with the express consent of the customer. . Excluded from this are the before/after pictures, which can be used anonymously for advertising purposes after consultation with the customer.
• ARB Fitness GmbH must maintain confidentiality about all information of the customer that becomes known in connection with the fulfillment of the training and support measures, even after the termination of the contractual relationship.

Non-utilization of the service

• If the provider's services are not used, the customer shall not be entitled to a price reduction or refund.
• If the paid training hours are not redeemed, the subscription and thus the entitlement to the service shall expire unless the contract holder(s) submits a credibly substantiated and written request for an extension of the term.

Other agreements

• Both parties recognize agreements and arrangements regarding the booking of services as binding, provided they have been confirmed by both parties. This applies to all means of communication used, including telephone or e-mail.
• Both parties undertake to be loyal to each other and will under no circumstances make negative comments about the person, products or services of the other party or damage the reputation and prestige of the other party.

Declaration of consent

• By using the services of the trainer, the customer agrees to the above GTCs in full.

Final provisions

• Amendments, supplements and ancillary agreements must be made in writing to be effective, unless otherwise stipulated in these GTC. The written form requirement also applies to the waiver of this formal requirement.
• Should any of the above provisions be invalid or unenforceable, this shall not affect the validity of the remaining provisions. The invalid or unenforceable provision shall be replaced by mutual agreement with a suitable, legally valid substitute provision that comes as close as possible to the economic purpose of the invalid or unenforceable provision.
• The place of jurisdiction shall be Zug. Swiss law shall apply.
